By accessing or using EV Rescue’s website, mobile app, or roadside assistance services (“Services”), you agree to these Terms of Service. If you do not agree to these terms, please do not use the Services.
2. Description of Service
EV Rescue provides mobile roadside assistance for electric vehicles throughout California, including mobile charging, tire services, lockout assistance, jump-starts, and towing coordination.
Service availability and response times may vary depending on location, traffic, and environmental conditions.
3. Membership Coverage
Each EV Rescue membership covers one (1) vehicle registered under the member’s account.
Additional vehicles at the same residential address may be added for $20 per year per vehicle.
Members must ensure that covered vehicle(s) are correctly listed and updated in their account profile.
Services are provided only to registered vehicle(s) associated with an active membership.
Transferring membership coverage to another vehicle requires prior notice and approval from EV Rescue.
4. Emergency Charging Service
EV Rescue provides emergency mobile charging to assist members whose EV batteries are depleted.
This service supplies a temporary charge sufficient to reach the nearest functional public charging station— it is not a full battery charge.
The amount of charge delivered may vary depending on vehicle type, battery condition, and environmental factors.
EV Rescue does not guarantee a specific range, percentage of charge, or charging time.
Members are responsible for proceeding to a full charging station after emergency service is complete.
5. Member Responsibilities
Members agree to:
Provide accurate contact, payment, and vehicle details.
Ensure the vehicle is parked safely and legally while awaiting service.
Follow all technician instructions and applicable traffic laws.
Secure personal property inside the vehicle before service begins.
6. Service Limitations
EV Rescue does not guarantee exact arrival times or successful resolution of every roadside situation.
Weather, traffic, or technical issues may delay or prevent service delivery.
Some requests may be referred to third-party providers at EV Rescue’s discretion.
7. Vehicle Condition and Risk
All roadside work involves inherent risks.
While technicians exercise reasonable care, EV Rescue is not responsible for pre-existing conditions, hidden defects, or incidental wear that may occur during service.
By requesting assistance, members acknowledge and accept these risks.
8. Limitation of Liability
To the fullest extent permitted by California law, EV Rescue LLC, its employees, contractors, and affiliates are not liable for any indirect, incidental, or consequential damages.
Any liability is limited to the amount paid for the specific service that gave rise to the claim.
9. Payments and Memberships
All payments and subscriptions are processed securely through third-party providers such as Stripe.
Memberships activate after payment processing, typically within seven (7) hours.
Prices, benefits, and terms are listed on our website and may change without prior notice.
If a member adds additional vehicles to their plan, the $20 annual fee per additional vehicle will be billed automatically to the same payment method on file.
10. Cancellations and Refunds
Members may cancel a service request before dispatch.
Membership fees are non-refundable except as required by California consumer protection laws.
EV Rescue reserves the right to suspend or terminate membership for fraudulent use, unsafe conditions, or abuse of services.
11. Privacy
Use of the Services is governed by EV Rescue’s Privacy Policy, which explains how we collect, use, and protect your personal information.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
